§ 1 Scope of application and provider
§ 1.1 These General Terms and Conditions apply to all orders placed via the online store ("Ginza Berlin", www.ginza-berlin.com) of Ginza Berlin GmbH, Pfalzburger Str. 20, 10719 Berlin, which is the contractual partner. Orders can only be placed by private individuals; it is not possible to apply the reverse charge procedure for customers from other EU countries.
§ 1.2 The offer of the online store is not accessible to persons who have not reached the age of 18. We will not conclude a contract with young people under the age of 18.
§ 2 Conclusion of contract
§ 2.1 The product presentations in the online store do not constitute a binding offer, but serve as an invitation to the buyer to submit a purchase offer. By clicking on the "Buy" button, you submit a binding purchase offer.
§ 2.2 We can accept your order by sending a separate order confirmation by e-mail or by delivering the goods within two days of receipt of the order. Confirmation of receipt of the order is sent by an automated e-mail immediately after the order has been sent and does not constitute acceptance of the contract.
§ 2.3 The ordering process is simple and transparent and comprises a total of five steps:
- Once you have found the product you want, you can add it to your shopping cart without obligation by clicking the "Add to cart" button.
- The shopping cart will then be displayed automatically. However, you can also view the contents of your shopping cart at any time without obligation by clicking on the "View shopping cart" link. You can remove products from your shopping cart at any time by reducing the order quantity to "0".
- If you want to buy the products in your shopping cart, click the "Checkout" button.
- Please enter your personal data, your shipping address and the payment information. The mandatory fields are marked with an *. Then click on the "Check order" button
- Checkyour product selection once again. Then complete the order process by clicking on the "Buy" button.
The entire process can be canceled at any time by closing the browser window.
§ 2.4 We save the text of the contract and send you the order data, our GTC and our cancellation policy by e-mail. For security reasons, your order data is no longer accessible via the Internet.
§ 3 Prices
§ 3.1 The prices stated on the product pages include statutory VAT and other price components and do not include shipping costs. We issue an invoice showing the value added tax.
§ 4 Shipping costs
§ 4.1 The shipping costs for delivery within Germany are € 6.99 incl. VAT. From an order value of €150.00 (product value less any discounts), shipping to Germany is free of charge. If the express option is selected, shipping costs €19.99 incl. VAT.
§ 4.2 The shipping costs for delivery to Belgium, Estonia, France, Latvia, Lithuania, Luxembourg, the Netherlands, Austria, and Slovakia are €14.99 including VAT.
§ 4.3 The shipping costs for delivery to Bulgaria, Finland, Greece, Ireland, Italy, Malta, Romania, Sweden, Spain, Hungary, Denmark, Croatia, Poland, Portugal, Slovenia, and the Czech Republic are $19.99 including VAT.
§ 4.4 During the order process in the online store, the shipping costs are calculated automatically and displayed on the order page.
§ 5 Terms of delivery
§ 5.1 Delivery is only made within the EU.
§ 5.2 Unless otherwise stated in the offer, the delivery time is 2-4 working days after receipt of payment for Germany-wide delivery or 3-5 working days after receipt of payment for EU-wide delivery.
§ 6 Terms of payment
§ 6.1 Payment shall be made in advance either by bank transfer, Paypal or credit card.
§ 6.2 If you select the payment method bank transfer, we will provide you with our bank details in the confirmation email. The amount to be paid must be transferred to our account within 10 days.
§ 7 Discount campaigns
§ 7.1 Discount promotions are limited in time and are only valid for the specified period. There is no minimum order value for discount promotions, shipping costs are not discounted. Discount campaigns cannot be combined with other promotion codes.
§ 8 Retention of title
§ 8.1 The goods shall remain our property until payment has been made in full. Prior to the transfer of ownership, pledging, transfer by way of security, processing or transformation is not permitted without our consent.
§ 9 Cancellation policy
§ 9.1 Consumers have a fourteen-day right of withdrawal.
Right of withdrawal
You have the right to revoke this contract within fourteen days without giving reasons. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took or has taken possession of the last goods. In order to exercise your right of withdrawal, you must give us,

inform us by means of a clear statement (e.g. a letter, fax or e-mail sent by post) of your decision to withdraw from this contract. You may use the attached model revocation form, which is not mandatory.
In order to comply with the revocation period, it is sufficient to send the notification of the exercise of the right of revocation before the end of the revocation period.
Consequences of revocation
If you revoke this Agreement, we shall reimburse you for all payments we have received from you, including delivery charges (except for additional charges resulting from your choosing a different method of delivery from the cheapest standard delivery offered by us), immediately and no later than fourteen days from the date we receive notification of your revocation of this Agreement. For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this refund. We may refuse to make a refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period expires. You are responsible for the direct costs of returning the goods. This also applies to return shipping costs incurred because a) you provided an incorrect address, b) you refused to accept the delivery, c) you did not pick up a shipment from a packing station within the specified time, or d) delivery was not possible for reasons for which Ginza Berlin is not responsible.
You shall only be liable for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary for testing the nature, properties and functioning of the goods.
§ 9.2 The right of withdrawal does not apply to contracts
- for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision of services. This includes in particular our fixed-schedule tasting events
- for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer
- for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded
- for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery
- for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature
- for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery
- for the delivery of newspapers, periodicals or magazines with the exception of subscription contracts
- for the delivery of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and the current value of which depends on fluctuations in the market over which the entrepreneur has no influence.
§ 10 Transport damage
§ 10.1 If goods are delivered with obvious transport damage, please complain about such defects immediately to the deliverer and contact us as soon as possible.
§ 10.2 Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, you will help us to assert our own claims against the carrier or the transport insurance company.
§ 11 Warranty
§ 11.1 The statutory warranty rights apply to the items offered in our store.
§ 12 Final provisions
§ 12.1 German law shall apply. This shall only apply to customers from other EU countries if this does not restrict any mandatory statutory provisions of the country in which the customer is domiciled or habitually resident.
§ 12.2 Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. The relevant statutory provisions shall apply in place of the invalid provision
§ 12.3 These GTC shall be deemed to have been agreed in German. Translations into other languages are for information purposes only. In the event of a conflict or contradiction between this translated version and the German version (including as a result of delays in translation), the German version shall prevail.
